Gordon Darby asks judge to hold New Hampshire in contempt over inspection drama

MANCHESTER, N.H.- The company which had been running New Hampshire’s vehicle emissions and inspection program has asked a judge that the state be held in contempt of court and fined for not enforcing vehicle inspections.

The lawsuit from Gordon Darby comes after a federal judge issued an injunction forcing the state to continue its vehicle inspection program which was scheduled to expire on January 31 following a new law passed last year.

In its suit Gordon Darby claims that New Hampshire has violated that court order on top of violating the EPA’s Clean Air Act.

The request by Gordon Darby comes after the Executive Council last month rejected a proposed 60-day contract extension with Darby and word that Governor Kelly Ayotte’s administrations is currently in talks with the EPA over ending the state’s involvement in the Clean Air Act.
